March 7, 2010: Deputy David Hawley with the Lincoln County Sheriff's Office responded to East Collins Street in Depoe Bay on a report of an intoxicated subject causing a disturbance and attempting to gain entry into a nearby apartment.
The male subject left the area in a vehicle prior to police arrival, but was located at a nearby address not far from the original location.
When Deputy Hawley located the man he noticed several signs of impairment and a DUII investigation was conducted.
The investigation revealed that John A. Bender, 33 years of age, from Depoe Bay was under the influence of intoxicants. A check of Bender's license revealed that his driving status was "Felony Revoked".
Deputy Hawley arrested Bender for Driving Under the Influence of Intoxicants, Driving While Revoked Felony, Criminal Trespass, and Disorderly Conduct.
Bender was transported to the Lincoln County Jail and submitted to a breath test which registered a .26% blood alcohol concentration. Bender was booked and lodged at the jail where he was held on a $125,000 bail.
